California Law Prohibits Race Discrimination in Employment
The California Fair Employment and Housing Act ("FEHA") makes it an unlawful employment practice for an employer to discriminate against an employee because of race. The prohibition against race dsicrimination means that employers may not take your race or color, or your perceived race or color, into consideration in making employment decisions. This prohibition not only protects minorities, but also protects the majority from reverse discrimination. When a non-minority employee brings a race discrimination claim, it is known as a "reverse discrimination" claim. Race discrimination laws also prohibit employers from retaliating against an employee for complaining about race discrimination, or supporting or participating in someone else's race discrimination claims. In addition, an inference of race discrimination may be raised through statistical evidence, comparative evidence, or direct evidence, such as discriminatory comments. When the evidence raises an inference of race discrimination, the employer generally must offer evidence to rebut the inference of discrimination. Depending on the strength of the employee's evidence of race discrimination , the employer’s burden may be to produce evidence of a legitimate reason, or if the employee provides strong or direct evidence, the employer’s burden may be to show by a preponderance of the evidence that the same decision would have been absent a discriminatory motive.
