California Law Prohibits Discrimination in Employment

California and Federal law prohibit discrimination against many types of protected classes of employees.

Title VII of the Civil Rights Act of 1964 is the federal law that prohibits employment discrimination. The federal law prohibits discrimination against employees, former employees and applicants for employment on the basis of color, gender, national origin, race, religion and sex.  Congress has also passed other anti-discrimination protections. The Americans with Disabilities Act prohibits disability discrimination, and the Age Discrimination in Employment Act protects individuals over the age of 40 from age discrimination.

In California, the primary law that protects against discrimination is the Fair Employment and Housing Act. The FEHA prohibits discrimination on because of: 

  • Age (40 and over)
  • Ancestry
  • Color
  • Denial of Family and Medical Care Leave
  • Disability (mental and physical)
  • Gender
  • Marital Status (Single or Married)
  • Medical Condition (Cancer and genetic characteristics)
  • National Origin
  • Race
  • Religion
  • Religious Creed
  • Sex
  • Sexual Orientation

 Employers are prohibited from taking adverse employment actions, which may include: 

  • Demotion
  • Discharge
  • Discipline (Oral and Writen Warnings)
  • Firing
  • Lay off
  • Negative references
  • Poor performance reviews
  • Reduction of pay
  • Reduction of paid work hours or overtime hours
  • Refusal to hire
  • Suspension
  • Termination of employment
  • Transfer or shift change
