California Law Prohibits Defamation
Employers may not make false statements of fact about you - orally or in writing - that damage your reputation. Such statements are often made when an employer is seeking to create false justifications for termination of your employment. Damage to reputation from defamation may be severe and impact the ability to obtain future employment.
The law makes two types of defamation unlawful (1) Libel and (2) Slander. Libel is written defamation. Slander is oral defamation. If the false statement is made to someone with an interest in hearing the information, you may need to show that the statement was made with malice to overcome what is called a qualified interest privilege. Such malice may ususally be shown when the statement is knowingly false or when the publisher has a animus or motive to falsify information about you.
